Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Florida Attics website, online quote tool, and any related services (collectively, the "Services"). The Services are operated by Yesod Inc., a Delaware corporation providing attic insulation services in Florida ("Yesod", "we", "us", or "our"). By accessing the Services, submitting any form, or requesting an inspection or quote, you ("you" or "Customer") agree to be bound by these Terms. If you do not agree, do not use the Services.

1. About Florida Attics

Florida Attics is a residential and commercial insulation service operated by Yesod Inc., a Delaware corporation. All work is performed in accordance with applicable Florida Building Code requirements and relevant local ordinances.

2. Estimates Are Not Binding Contracts

Any price, estimate, range, or figure displayed, communicated, or generated through the Services — whether automatically calculated, verbally stated, texted, emailed, or shown on any screen — is a preliminary, non-binding estimate only and does not constitute an offer, contract, or commitment of any kind.

Yesod Inc. expressly reserves the right, at its sole and absolute discretion and at any time before a fully executed written agreement is signed by an authorized officer of Yesod Inc., to:

No binding agreement exists between you and Yesod Inc. until (a) a written proposal or contract is issued by Yesod Inc., (b) you have signed that document, and (c) Yesod Inc. counter-signs it. Electronic acknowledgment of these Terms does not create a contract for services.

3. Savings & ROI Projections Are Illustrative

Any projected savings, return on investment, energy reduction percentages, utility bill estimates, or payback periods displayed by the Services are illustrative approximations based on general industry data and regional averages. Actual results will vary materially depending on your specific home construction, HVAC system, usage habits, utility rates, weather, and other factors. Yesod Inc. makes no warranty, representation, or guarantee that any projected savings will be achieved. You should not rely on savings projections when making financial decisions.

4. Inspection Scheduling

Selecting a date or time window through the Services does not constitute a confirmed appointment. Appointments are confirmed only when a Yesod Inc. representative contacts you directly. Yesod Inc. reserves the right to reschedule, cancel, or decline any inspection appointment at any time without liability. No fee of any kind is due until you receive and sign a formal service agreement.

5. No Warranties on the Services

THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. YESOD INC. DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE FLORIDA LAW, YESOD INC. AND ITS OFFICERS, MEMBERS, EMPLOYEES, AGENTS, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES OR ANY ESTIMATE PROVIDED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), EVEN IF YESOD INC. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL YESOD INC.'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF (A) ANY AMOUNTS YOU HAVE ACTUALLY PAID TO YESOD INC. IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

7. Data You Submit

By submitting your name, phone number, email address, property information, or any other data through the Services, you consent to Yesod Inc. contacting you via phone, text message (SMS/MMS), or email regarding your quote request, inspection scheduling, and related services. You may opt out at any time by replying STOP to any text message or by emailing us at the address below. Standard carrier message and data rates may apply.

Yesod Inc. will not sell your personal information to third parties. Information may be shared with service providers who assist in operating the Services, subject to confidentiality obligations.

8. Third-Party Data Sources

The Services may retrieve property information from third-party data providers (such as public records, MLS data, or mapping APIs). Yesod Inc. makes no representation as to the accuracy or completeness of third-party data. You should verify all property details independently.

9. Intellectual Property

All content, trademarks, logos, software, and materials on or accessible through the Services are the exclusive property of Yesod Inc. or its licensors. You may not copy, reproduce, distribute, or create derivative works without prior written consent.

10. Indemnification

You agree to defend, indemnify, and hold harmless Yesod Inc. and its officers, members, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from (a) your use of the Services, (b) your violation of these Terms, or (c) your violation of any third-party rights.

11. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Orange County, Florida, and you irrevocably consent to the personal jurisdiction of such courts.

YOU AND YESOD INC. AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO A JURY TRIAL IN ANY ACTION ARISING OUT OF OR RELATED TO THESE TERMS.

12. Modifications to These Terms

Yesod Inc. reserves the right to update or modify these Terms at any time without prior notice. Changes become effective upon posting to this page. Your continued use of the Services after any modification constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

13. Entire Agreement & Severability

These Terms constitute the entire agreement between you and Yesod Inc. with respect to the Services and supersede all prior agreements, representations, and understandings. If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
